Terms and conditions

1. General

All bookings are made with Samui Island Villas (referred to as SIV) acting as agents on behalf of the owners/managers of the properties featured in this website and the person signing the booking form, who must be over 21 years of age and who shall be deemed to sign the booking form on behalf of all the persons herein. All bookings are made subject to the acceptance of the following terms and conditions.

2. Bookings

2.1 Provisional confirmation of availability and rates

Upon receipt of a request for availability, the applicable property rates and the amount of deposit required will be advised. The minimum number of nights may vary as well as specific conditions for Easter, Summer Holidays, Christmas and New Year (see individual property descriptions for more information). Property rental rates are quoted on a daily basis in US Dollars and include maid service, gardening and pool services, electricity, gas and water. All properties are fully equipped with linen, towels, crockery, utensils and an initial supply of soap and toiletries.

2.2 Exclusions and additional charges

The rates quoted do not include baggage handling, gratuities, telephone, fax and internet charges, vehicle rental, food and beverage, personal items and other expenses. Any excessive cleaning, excessive use of air conditioning, damage to fixtures and fittings or the replacement of breakages. Fair wear and tear accepted.

2.3 Initial deposit

A completed booking form and an initial deposit of 35 - 50% of the total charge is required to confirm a booking. For bookings of less than 1 week (1-6 nights) or for bookings made within 60 days of arrival, full payment is due at the time of the booking.

No contractual obligation shall exist until we have received the assigned booking form and the correct deposit payment or full payment and we have confirmed the reservation in writing. Bookings are accepted on a "first come" "first served" basis. If the payment is not received by return in respect of credit/debit card payments or within 5 days in respect of bank transfers the booking shall be considered cancelled.

3. Payment

3.1 Method of payment

We accept payment by bank transfer or by credit/debit card (a transaction fee is applied to all credit/debit card payments).

We will not be held liable for any credit/debit card charge backs made against us.

3.2 Payment due date

Payment of the outstanding balance must be received at least 60 days prior to arrival. If SIV does not receive the balance by the due date, SIV reserve the right to cancel the booking and cancellation charges will apply. For bookings of less than one week (1-6 nights) or for bookings made within 60 days of arrival, full payments is due at the time of the booking.

4. Cancellation and Amendments

4.1 Cancellation

You may cancel your reservation at any time by notifying SIV by email. In the event of cancellation or if SIV cancels the booking due to non-payment of the balance by the specified date the following cancellation charge shall apply:

4.2 Amendments

A $50 US Dollar administration fee may be applied by SIV for any changes to the arrival or departure dates after a booking confirmation has been issued. Acceptance of any change is subject to approval by the property owner/manager.

5. Arrival and Departure Times

Guests should assume the check in time is 3:00 pm and the check out time is 12:00 noon unless otherwise stated in the property description.

Consideration is given where possible for early flight arrival and late departure times.

6. Alteration or Cancellation by SIV

In the unlikely event that SIV or the property owner/manager have to make any changes to confirmed bookings you will be advised by email at the earliest possible date.

If the property is damaged or rendered unusable, or if for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the property of your choice, SIV and the property owner/manager will endeavour to provide an alternative property for the duration. If this is not possible, or you do not wish to accept the alternative property offered you will be refunded in full (less any bank charges or credit/debit card transaction fees)

SIV shall not be liable for any further obligations or claims whatsoever.

7. Registered Guests

Only those persons stipulated on the booking form may reside at the property as guests. Please notify us of any changes you wish to make. The number of people staying at the property including children, must not exceed the maximum capacity indicated in the property description, except in the case of infants under two years old, or unless specifically authorised by SIV in writing.

Should SIV or the owner/manager of the property find that the number of persons staying at the property exceeds that on the booking form, the additional guest(s) will be subject to a per night surcharge or asked to vacate the property forthwith.

No camping permitted in the grounds of the property and no pets allowed.

Smoking is not allowed inside the property, though it is permitted outside on the terrace. Your co-operation is therefore requested and appreciated.

The person signing the booking form is responsible for the conduct and appropriate behaviour of all guests residing at the property. Should any guest(s) not behave in an appropriate manner SIV or the owner/manager has the absolute discretion to ask the offending guest(s) to vacate the property forthwith.

It is absolutely prohibited for guests to allow prostitutes, illegal or immoral activities within the private boundaries of the property.

8. Security Deposit

A security deposit may be payable on arrival (see individual property descriptions). This is to cover the cost of any additional services, damage caused to the property, its fixtures and fittings or breakages during the rental period. This amount will be refunded at the time of departure less any such costs.

9. Insurance

It is a condition of booking that all guests are covered by comprehensive travel insurance including, but not limited to cancellation/curtailment, medical emergency, repatriation and associated expenses, loss of, and damage to personal property and belongings, third party liability, locally procured third party services including, but not limited to watercraft, water sports and vehicle rental.

We strongly recommend this be arranged once your reservation is confirmed.

10. Liability Releases

SIV and the owner/manager accept no responsibility or liability for death, personal injury, sickness, accident, delay, loss of luggage or any other loss or misadventure.

SIV and the owner/manager accept no responsibility or liability for any loss or damage or alteration in the terms of the booking caused by events beyond our control, including but not restricted to war, terrorist activity, civil commotion, flight delays or cancellation, airport closure, adverse weather conditions, fire, flood and industrial dispute.

SIV and the owner/manager accept no responsibility or liability for the failure of public services, such as electricity or water supply. Nor for the consequences of the actions or omissions of persons who may supply or control main services, or any actions taken in the vicinity of the property reserved, by any authority or persons over which we have no control. We cannot accept any liability for the failure of the air-conditioning, internet connection, pool filtration system or any household appliance. Urgent steps will be taken for a local engineer to rectify any problem. SIV accepts no responsibility for any modification made not mentioned on the website or anywhere else.

SIV and the owner/manager accept no responsibility or liability for your personal safety. Use of the property amenities including the pool is entirely at your own risk.

11. Linens and Towels

Linens and towels are provided in all properties and are changed on a regular basis. If you require more frequent changes there may be an extra charge. Limited laundry facilities may exist on site, and charged per item. Outside laundry services are available for a small charge and must be paid for at the time

12. Complaints

All property descriptions in this website are provided in good faith and SIV accept no liability for any errors or omissions.

Should you experience any problems whatsoever with the villa during your stay that cannot be rectified by the owner/manager please contact SIV who will do their best to assist and rectify the matter as soon as practically possible. We cannot resolve a problem for you unless we are notified at the time. Please give us the opportunity to correct matters. Should a problem remain unresolved you are asked to notify us in writing within 48 hours of vacating the property. No action can be taken or liability accepted for any complaints received after this period. We aim to resolve complaints within a reasonable period of time, the details of which will be kept confidential to only the parties involved.

13. Applicable Law

These conditions and any contract to which they apply are governed in all respects by Thai Law and the Thai Law Courts only shall have sole jurisdiction in relation to any claim or dispute arising out of or connected with them.
